Though the US Supreme Court has not yet ruled out the death penalty entirely, recent decisions have continued to narrow the conditions under which states can impose it.

An unfortunate result of the trend could be a temptation for states to resort all too readily to the executions still acceptable under the court's terms.

The best result would be a brake on states contemplating capital punishment on any grounds.
