Colleges may not require draft registration for loans

June 20, 1983

A federal judge ordered colleges not to require male students to disclose whether they have registered for the draft as a condition for receiving government-backed student loans.

US District Court Judge Donald Alsop said an amendment added by Congress last year to the 1983 Defense Authorization Act had violated provisions of the US Constitution which guarantee free speech and protection against self-incrimination. The Selective Service System said it would appeal the decision to the US Supreme Court.
