Antibusing measure upheld in California

March 13, 1981

The California Supreme Court Thursday upheld the constitutionality of the state antibusing measure passed by voters as Proposition 1 in november 1979. The court refused to accept a petition for a hearing filed by the American Civil Liberties Union of Southern California. The ACLU had urged reversal of a State Appeal Court decision that in effect nullified courtordered busing in Los Angeles.

The Appeal Court ruled in December 1980 that the proposition, which was approved by a 2-1 voter margin, did not discriminate against racial minorities and was therefore constitutional.
