Attorney General Mark Herring has concluded that Virginia's gay marriage ban is in violation of the US constitution and he will not defend it. The Virginia shift comes after federal judges recently struck down gay marriage bans in Utah and Oklahoma.
As reflected in polls and recent ballot measures, public opinion is moving in favor of same-sex marriage. Now that the US Supreme Court has agreed to take up the issue, both sides in the debate look for clear legal resolution.
Proponents of California's Prop. 8 gay marriage ban say the 2010 ruling against it should be vacated because the judge failed to disclose that he was in a long-term gay relationship.
